Offense-Defense: Advanced Investigations for Legal or Claims Professionals
The accessibility of modern investigations has expanded rapidly over the past decade. This presentation will address how we can use different tools to enhance investigations in worker’s compensation cases, along with strategies to help us protect our own anonymity in the process.

Scott Schultz, DigiStream

Scott Schultz has been part of DigiStream’s team for 8 years. He works on a national level working in several industries with DigiStream’s partners. He has spent the last 5 years traveling around the country as an educator, presenting to various cross-industry events. Scott began his career as a field investigator and is licensed as a private investigator in numerous states. His interest in the private sector began during his undergraduate study at Loyola University Chicago, where he majored in Criminal Justice, International Relations, and French.

Garrett McGinn, DigiStream

Garrett McGinn is a Partner with DigiStream Investigations’ Research & Development Department and its complex investigations company UpStream Intelligence. He has over 17 years of investigative experience and is a Certified Fraud Examiner, a licensed Private Investigator and holds a master’s degree in Transatlantic Relations from Jagiellonian University in Krakow Poland, and a bachelor’s degree in International Relations from the University of California, Davis. Mr. McGinn trained in advanced surveillance tactics in the United Kingdom, achieving a Level III Advanced Award in Foot & Mobile Surveillance.

Binaural Bickering? Two Perspectives on Hearing Loss Claims
Hear (pun intended) from two experts who practice across the aisle regarding how they evaluate hearing loss claims and their strategies for pursuing or defending such claims.

Attorney Mary Beth Hughes, Scopelitis, Garvin, Light, Hanson & Feary

Mary Beth Hughes focuses her practice on worker’s compensation law, including litigating Wisconsin worker’s compensation cases and counseling employers on issues related to health and safety, accommodating disabilities, and other employment-related decisions following a work injury. Mary Beth works with employers to aggressively defend workers’ compensation claims and strategically manage both small and large cases to a positive conclusion.  Mary Beth graduated with a B.A. from the University of Notre Dame and a J.D. from the University of Wisconsin.  She is a partner with the Scopelitis Milwaukee office.

Attorney Jaron Mosier, Mosier Law

Jaron is a passionate advocate on behalf of workers and retirees who have sustained occupational hearing loss. Because Jaron formerly represented employers and insurance companies in hearing loss litigation, he knows how to aggressively assert the most compelling claims on behalf of his clients. Jaron has handled hundreds of hearing loss claims across Wisconsin, including the important 2018 Court of Appeal award of benefits for a worker who sustained a hearing loss of nearly 85%, Harley-Davidson v. LIRC.A Horicon native, Jaron graduated from Marquette University Law School. He is a member of the Wisconsin Association of Workers Compensation Attorneys (WAWCA). He has been named to SuperLawyers Magazine’s list of Rising Stars from 2013-2019. Jaron and his family reside in Oconomowoc.

The Use of Workplace Intelligence in Medical Causation Determinations
Through the use of real-life cases studies, medical expert Dr. Koehler and biomechanical engineer Luis Vargas will discuss how workplace investigations and accident reconstruction can affect a doctor’s opinion regarding causation and mechanism of injury. These experts will also address how injury re-enactments, video footage, witness statements, etc. can most effectively be used to defend against a worker’s compensation claim.

Dr. John Koehler, OCC DOC ONE

Dr. Koehler founded his Occupational Medicine practice 1987 in Rockford, IL. Under his leadership and commitment to quality patient care his group grew to 56 clinics in Illinois, Indiana, and Wisconsin serving over 10,000 corporate clients. In addition, he has served as occupational medical advisor to multiple fortune 100 employers including Exelon, Constellation, Pratt & Whitney, Collins Aerospace and Intren.He is a co-founder of the Urgent Care Association of America, the industry’s trade association, and he has established several other organizations focused on Occupational Medicine. In 2009, he received the Lifetime Achievement Award from the Urgent Care Association of America and was recently named as one of the top 15 influencers of this industry through 2014.Dr. Koehler completed his residency in occupational medicine at the University of California, San Francisco, and a residency in emergency medicine at Butterworth Hospital, Grand Rapids, Mich. He received his MD degree from The Pennsylvania State University College of Medicine and earned a bachelor’s degree in biology from Wheaton College.

Luis Vargas, ARCCA

Dr. Vargas is a Senior Biomechanist at ARCCA. He has over six years of experience working in and collaborating with various biomedical research laboratories dedicated to assessing and improving the body’s response to physical and neurological injuries. His research experience has involved evaluating the kinematics of human movement, developing novel techniques and devices aimed at overcoming neurological deficiencies, and performing human subject testing with various clinical populations. He has gained a solid background in engineering, physics, and anatomy through his research and coursework.

Dr. Vargas is skilled in design, data acquisition/analysis, and has published his work in several journals and presented at various international conferences. While at ARCCA, Dr. Vargas utilizes these skills to assist in research-based projects and evaluations aimed at quantifying the severity and impact mechanics of vehicular collisions, slip/trip and fall events, and other unique loading scenarios. These evaluations are achieved through the understanding of an individual’s personal response to an event and the associated injury mechanisms in order to uncover incident severity and injury causation.

Some of his professional affiliations are the Biomedical Engineering Society (BMES), Society of Neuroscience (SfN), IEEE Robotics and Automation Society (RAS), IEEE Engineering in Medicine and Biology Society (EMBS), and the Society of Automotive Engineers (SAE).


Attorney Stephen J. McManus, McManus & Associates, LLC - Moderator

Steve is an experienced litigator and educator. He earned his BA in Education and Spanish with a minor in Political Science from the University of Arizona. After graduating from the University of Arizona College of Law, Steve joined the Air Force Judge Advocate General’s (JAG) Corps. After completing Officer Training School, he had assignments in New Mexico and England. He deployed during Operation Allied Force.

In 2000, Steve relocated to Wisconsin. He initially joined Halling & Cayo, S.C., where his litigation practice included military defense, worker’s compensation, insurance defense, and professional licensing. In 2002, Steve was a founding partner of Nowakowski & McManus, LLP. Then in 2015, Steve created McManus & Associates LLC to carry on his litigation practice. Steve has earned his AV rating and was name “Top Rated Lawyer in Litigation” from Martindale-Hubbell ®.

Steve continues to be as a reservist in the JAG Corps, presently assigned to Headquarters Air Force Reserve Command. He will retire in early 2024, after 30 years of service. For nine years, he was the Director of the TRIALS Team, where he trained young JAGs about litigation tactics. Steve volunteers at Irish Fest and is also a board member for the Wisconsin Coalition of Virtual Schools Families.

Steve is married to Moira (née Dempsey) of Wilmette, Illinois. They live in Elm Grove, WI, where they have raised their eight children.

PTSD: Understanding the Proper Diagnosis and Its Effect on Other Conditions
In this presentation, Dr. Saunders with address how to properly diagnose post-traumatic stress disorder (PTSD), focusing on criteria that often confuses both patients and clinicians alike. He will also discuss how mental health conditions can affect other common worker’s compensation injuries.

Dr. Stephen Saunders, Marquette University

Dr. Stephen Saunders obtained his doctorate in clinical psychology from Northwestern University. He joined the faculty at Marquette University in 1994, where he is now Professor of Psychology and has also served as the Chairperson of the Psychology Department. He has published four books and over 80 articles and chapters, and he has made over 200 presentations regarding the mental health service delivery system.

Case Law and Legislative Update
Attorney Clark will provide an update on recent cases of significance. She will also provide an update on recent statutory changes and legislative proposals that could impact our worker’s compensation system.

Attorney Hayley Clark, Aplin and Ringsmuth

Hayley is a senior associate at Aplin & Ringsmuth, LLC, working in the Waukesha office.  She has spent her legal career exclusively representing employers and insurance carriers in the defense of worker’s compensation claims. She is also an adjunct professor teaching the worker’s compensation course offered every other year at the University of Wisconsin Law School.Hayley earned an undergraduate degree in business from Illinois State University in Normal, Illinois before attending the University of Wisconsin Law School in Madison, Wisconsin.

Complicated Foot and Ankle Injuries
Dr. Alex Burton will explore complicated foot and ankle injuries including ruptures, wound care, Charcot foot (neuropathy), foot drop, fractures, CRPS and more! His discussion will also include the assessment of potential red flags, age and weight-related comorbidities, and the use of evidence-based treatment to maximize recovery and function.

Dr. Burton is in active practice at Froedtert & Medical College of Wisconsin. His areas of expertise are:

  • Foot & Ankle Disorders
  • All lower extremity orthopedic surgeries, including arthroplasty of the Ankle, Knee and Hip
  • Orthopedic trauma of the whole body, especially the lower extremity.

Mock IME: A Behind the Scenes Look at an Independent Medical Examination
In this interactive and entertaining presentation, Dr. Maldonado will conduct an IME on a live “claimant,” taking the audience through each part of the examination, what he is looking for, and how the results of the examination ultimately impact his medical conclusions.

Dr. Dennys Maldonado, Mercy Health

Dr. Dennys E. Maldonado is originally from Puerto Rico but raised in Milwaukee, Wisconsin. He earned a Bachelor’s degree in Microbiology with a minor in Chemistry and Spanish from the University of Wisconsin-Milwaukee. He received his Medical Doctorate from Ross University School of Medicine in Dominica, West Indies. He completed his Family Medicine residency at Mercy Health System in Janesville, WI as well as his Primary Care Sports Medicine Fellowship.Dr. Maldonado has 18 years of experience in Primary Care Sports Medicine and Family Medicine. Dr. Maldonado has 3+ years of experience performing IME’s and independent chart reviews as the owner of Wobaaca, LLC. Dr. Maldonado also serves as Head Team Physician for all sports at the University Of Wisconsin – Whitewater. Dr. Maldonado is the Director of the Mercy Health System Primary Care Sports Medicine Fellowship and runs a successful Sports Medicine Clinic at Mercy Health in Janesville, WI.In addition, Dr. Maldonado is experienced in the treatment of all musculoskeletal complaints and treatments, including concussions,  Tenex tenotomy, Prolotherapy, Platelet-rich Plasma therapy and other biologics.

Dr. Maldonado is a member of the American Academy of Family Physicians and the American Medical Society for Sports Medicine. He is board certified  in Family Medicine with added qualifications in Sports Medicine. Dr. Maldonado resides in Janesville, WI with his wife and 4 girls.
